Terms of service.

1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you ("Client") and Double Eagle Landscaping ("Company" or "DEL") regarding the provision of landscaping services. By hiring DEL, you acknowledge and agree to these terms.

2. Services

DEL provides landscaping services, including but not limited to:

  • Lawn maintenance (mowing, edging, weeding, and blowing).

  • Tree trimming and arborist services.

  • Landscaping design and installation.

  • Seasonal clean-ups and debris removal.

  • HOA property management assistance.

The specific scope of services will be detailed in a written estimate or agreement provided to the Client before services begin.

3. Estimates and Pricing

  • All estimates are valid for 30 days from the date of issuance.

  • Pricing may vary based on the scope of work, materials required, and seasonal demand.

  • Additional services requested outside the agreed scope may incur extra charges. These will be communicated and approved by the Client before proceeding.

4. Payment Terms

  • Payment is due upon completion of services unless otherwise agreed in writing.

  • For ongoing services (e.g., HOA contracts or Residential Service Packages), invoices will be issued monthly and are due on the 1st of each month.

  • Late payments may incur a fee of 5% of the total invoice per month.

  • Accepted payment methods include cash, checks, credit card, or electronic transfers.

5. Scheduling and Cancellations

  • Services are scheduled based on mutual availability and weather conditions.

  • The Client must provide at least 48 hours’ notice for cancellations or rescheduling. Failure to do so may result in a cancellation fee of 50% of the scheduled service cost.

  • DEL reserves the right to reschedule services due to adverse weather or unforeseen circumstances.

6. Client Responsibilities

  • The Client must ensure access to the property on the scheduled service date.

  • Pets, children, and obstacles should be kept away from work areas to ensure safety and efficiency.

  • Any existing damage to the property (e.g., sprinklers, structures, plants) must be disclosed to DEL before services commence.

7. Liability and Warranty

  • DEL will exercise reasonable care and skill in providing services. However, the Company is not liable for:

    • Pre-existing conditions or damages on the property.

    • Damage caused by factors beyond our control, such as extreme weather or pests.

    • Accidental damage to underground utilities not disclosed by the Client.

  • DEL warrants its work for a period of 30 days following completion, excluding damage caused by the Client or external factors.

8. Materials and Subcontractors

  • DEL reserves the right to use subcontractors for specialized tasks, such as tree trimming, under formal agreements.

  • Materials used (e.g., plants, mulch, stones) will be of standard industry quality. Any specific material requests must be communicated in advance.

9. Termination

  • Either party may terminate the agreement with 30 days’ written notice.

  • DEL may terminate the agreement immediately if the Client breaches any terms or fails to make timely payments.

  • Residential Clients cancelling the Double Eagle Package prior to making final payment will be responsible for a cancellation fee for the cost of the lawn leveling service. This fee is calculated using the following formula: (Turf Area/1000) x ($350 - (# of payments x 29.16))

10. Dispute Resolution

  • Any disputes will first be attempted to be resolved amicably through negotiation.

  • If unresolved, disputes will be subject to mediation or arbitration as per Texas state laws.

11. Governing Law

These terms are governed by the laws of the State of Texas. Any legal action must be brought within the jurisdiction of Hays County TX.

12. Amendments

DEL reserves the right to amend these Terms and Conditions at any time. Clients will be notified of significant changes in writing.
